How to file a complaint


1. Document the fault

When you discover faults or defects, it is important that you document what is wrong. You need to be able to show the company what you think is wrong and the documentation becomes important if you and the company do not agree on the fault.

You can document the fault by taking pictures or filming, for example. Remember that the quality needs to be good enough that the fault is clearly visible. Sometimes, you may need to take several pictures to be able to show the fault in a good way. Both close-ups and pictures that show what the fault looks like in relation to the surroundings may be needed.

When it's not possible to document the fault

Some faults may be difficult to capture with for example pictures. In such cases, you can describe the fault when you contact the company to complain. Sometimes you may need to seek assistance from an expert to assess the work. For example if you have renovated the bathroom, it may work well to take a picture showing the tile work has been sloppily done. But if there are deficiencies in the moisture barrier or pipe installations, you may need to seek the help of a surveyor to assess the deficiencies.


2. Find out about your rights

What can you demand of the contractor?

The Consumer Services Act determines what demands you can make.

Firstly: that the company fixes the fault

You can firstly demand that the company fixes the fault free of charge. Free of charge means that the company must bear all of the costs associated with fixing the fault – such as materials, travel and labour. 

Even if you prefer to turn to another company, the contractor usually has the right to attempt to fix the fault. The fact that you are dissatisfied or have lost confidence is usually not sufficient. However, if it is obvious that the contractor does not have the right skills to fix the fault, you can argue that you should receive a price reduction or cancel the agreement.

Secondly: that you receive a price reduction

The price reduction should match the defect, such as what it costs to have the defect fixed by another company. If it is a cosmetic flaw that does not affect the functionality? Then a price reduction corresponding to the depreciation caused by the flaw may be applicable.

Thirdly: that you can revoke the agreement

Revoking the agreement means that the work is discontinued.

If the entire contract is revoked, the company is not entitled to payment. However, you may need to return materials if it does not cause significant inconvenience or cost to you.

If you benefit from parts of the work that has been done, the entire contract is not revoked. In that case, you must pay the contractor for the work you benefit from.

The contractor is obligated to give you a correct advise

The contractor is obligated to advise you against getting work done that is of no benefit to you. For example, if the company has replaced roof tiles even though they have seen that the entire roof needs to be repaired.

How long may it take to remedy the fault

The contractor must remedy the fault within a reasonable time. What is considered reasonable time varies from case to case. It depends, among other things, on the type of fault and your need to have it remedied. In some cases, the fault must be remedied quickly to avoid it worsening or causing other damages. Or the fault may significantly affect your daily life, for example if you cannot use the bathroom.

In other cases, it may be less urgent to remedy the fault. The season may also prevent the fault from being remedied immediately. For example it may be inappropriate to repaint the facade in the winter.

Compensation on the grounds of the fault

It is the company that must bear any costs or financial losses that you incur due to the fault. Examples of this may be:

  • Loss of income, for example if you have to take time off of work to inspect the fault together with the company

  • Cost for an opinion from an inspector or other expert (if needed to be able to prove the fault)

You must be able to prove your costs

You need to be able to present documentation on what costs you have had and the costs must be reasonable and have a direct connection to the fault or defect. Documentation can, for example, be receipts, invoices or certificates.

Remember that it is actual costs, not the trouble or the time you spend on the complaint, that you can demand compensation for.

If the contractor caused damage

According to the Consumer Services Act, you have the right to demand damages from the company if they cause damage in connection with the service being performed. This may involve the object of the service being damaged or the company damaging something else on your property; for example, if the company you engaged to repair your heat pump drops a tool that causes damage to the floor.

The compensation is intended to cover the damage. You cannot expect to receive compensation for anything that puts you in a better position than before the damage occurred. For example if you have a scratch on the floor, it is not reasonable for you to get the entire floor replaced at no cost. Sometimes the company that caused the damage has the expertise to remedy it. In that case, you may need to accept that the company fixes the damage instead of providing you with financial compensation.

How much time do you have to file complaint about defects

Skilled trade services are covered by the Consumer Services Act. In the law, there are 2 different time limits for how much time you have to file complaints about faults, depending on what kind of service is involved. For work on real property, you have the right to file complaint on the fault for ten years. Work on real property encompasses, among other things:

  • building renovations

  • painting

  • floor laying

  • drainage

  • re-roofing

  • drilling of water wells

  • fiber burial

For work that is not done on land, buildings or other fixed objects, you have a 3-year guarantee. For example, there is a 3-year guarantee on most repair services. If you engage a company to repair your broken heat pump, the 3-year limit for guarantee claims applies.


3. Contact the contractor and ask that the fault be fixed

After you have discovered a defect, it is important that you contact the company as soon as possible to give them the chance to investigate and fix the defect. It is somewhat common for the company to need to come out and look at the fault to be able to decide what needs to be done.

You do not need to know the cause of the fault when you contact the company. What is important is that you point out that you discovered a fault as soon as possible. However, you may be obliged to compensate the company for the inspection if it turns out that the fault was not caused by their work.

Contact the company in writing

It is always good to have written documentation that shows that you contacted the company to file complaint. If possible, it is therefore good to send a text message or email. Then, you can also attach documentation that shows the fault, such as pictures. If you call, it can be helpful to summarize what you discussed after the call and send it in an email to the company.

Claims for compensation

If you have claims for compensation for additional expenses or damages, you should also direct that claim to the company. Specify the costs you want the company to compensate and provide reasons why.


4. Your right to withhold payment

If the service is incorrect, you have the right by law to withhold part or all of the payment as security. This serves as a means of pressure on the company and a security for you.

You can withhold a significant portion of the payment

The part of the payment you withhold should correspond to the fault. This essentially means that you can withhold such a large amount that it covers the cost to bring in another company to fix the faults. Sometimes, it can help to contact other companies in the industry to get a price quote for what it would cost to fix the fault.

Notify the company that you are withholding payment

It is important that you notify the company in writing that you are withholding payment and why. You can send an email or a text message, for example. If you have received an invoice, you need to dispute it. This means that you declare that you will not pay the invoice and why. Be clear that it is because there are errors in the work and that you are withholding all or part of the payment.

Compensation for damages caused by the company

If the company has caused damage to something else in your home, you cannot withhold an equivalent amount from the invoice for the service the company has performed. If the company has completed the service without any errors, you are obligated to pay the invoice even if you have compensation claims for other damages they have caused.

You can present the compensation claims you have for the damages as separate claims to the company.


5. What to do if the contractor does not fix the fault

The contractor disagrees with the fault

If the company disagrees with you about the fault being due to their work, there are some things you may need to do to move forward. You need to be able to show that the fault is due to the company's work. If you cannot demonstrate the fault through pictures or similar means, you can seek assistance from an expert, such as a surveyor. The expert will assess and provide an opinion on the work. Ensure that you obtain written documentation from the expert and keep it as evidence.

Contact the contractor again

If you have further evidence that the contractor has made a mistake, you should contact the contractor again. Remember to contact them in writing, such as via email or text message. Include a copy of the evidence. If the contractor still denies or does not respond, you can have your case reviewed, for example, by the National Board for Consumer Disputes.

The company does not fix the fault

If the contractor does not fix the fault within a reasonable time, you can turn to another company.

What is a reasonable time?

According to the law, the contractor must fix the fault within a reasonable time. What constitutes a reasonable time is assessed on a case-by-case basis. It depends, among other things, on the type of fault and your need to have it fixed.

Sometimes, the fault must be fixed quickly to avoid it worsening or causing other damages. Or the fault may significantly affect your daily life, for example if you cannot use the bathroom.

In other cases, it may be less urgent to remedy the fault. The season may also prevent immediate fault rectification. For example it may be inappropriate to repaint the facade in winter.

Contact the contractor once more

If you feel it is taking too long, you should contact the contractor again in writing, for example, via email or text message. Explain that if the contractor cannot fix the faults promptly, you will need to turn to another company. It is important that you can demonstrate that you have complained about the delay before turning to another company.

If you have withheld payment due to the fault, you can simultaneously notify that you intend to use that sum to cover the work.

If you have already paid for the work, you can notify that you will demand compensation for the cost of hiring another company.

7. Have your case reviewed

Free dispute resolution through the National Board for Consumer Disputes

If you and the company cannot reach an agreement, you can make a complaint to the public authority “Allmänna reklamationsnämnden” (ARN) [The National Board for Consumer Disputes]. ARN will assess your case and provide a recommendation on how to resolve the dispute. Most companies follow ARN's recommendations. It does not cost anything to have your case reviewed by ARN. The normal processing time is approximately 6 months. In some cases, it can be quicker and in others it may take longer.

If the company has refused your demands, you can make a direct complaint. If you have not received a response from the company, you must wait for 30 days before you can make a complaint to ARN. If you complain earlier, your complaint will be rejected.

Requirements for ARN to consider your case
  • The company has either fully or partially rejected your claim, or has not responded to you.

  • The amount that you and the company cannot agree on exceeds ARN's value limit.

  • You must make the complaint within 1 year of the date you first complained to the company.

Sometimes the municipal consumer advisors can assist you in making a complaint to ARN.

Settle the dispute in court

If you have gone through the steps in this process but still have a dispute with the company, you can take the dispute to court. In that case, you should contact the district court (tingsrätten). Unlike making a complaint to ARN, it costs money to file an application with the court.

For a dispute involving a claim of up to 28,650 Swedish kronor (half a price base amount in 2024), known as a simplified litigation or small claim, the application fee is 900 kronor. If the claim exceeds 28,650 kronor, or if the dispute does not concern a specific amount, the application fee is 2,800 kronor.

If you lose the dispute, you may be required to pay both your and the company's legal costs. However, in small claims, the costs you may have to pay are limited.

1. Dokumentera felet

När du upptäcker fel eller brister är det viktigt att dokumentera. Du behöver kunna visa företaget vad du tycker är fel. Dokumentationen blir också viktig om du och företaget inte kommer överens. Spara därför allt underlag.

Så kan du dokumentera

Du kan dokumentera fel genom att till exempel ta bilder eller filma. Kvaliteten behöver vara så bra att felet syns tydligt. Det kan behövas både närbilder och bilder som visar hur felet ser ut i förhållande till omgivningen.

Går det inte att dokumentera felet?

Vissa fel kan vara svåra att visa med till exempel bilder. Då kan du istället beskriva felet när du kontaktar företaget för att klaga. Ibland kan du behöva ta hjälp av en sakkunnig som får bedöma arbetet. Har du till exempel renoverat badrummet kan det fungera bra att ta en bild som visar att kakelarbetet är slarvigt utfört. Finns det däremot brister i fuktspärr eller rördragningar kan du behöva ta hjälp av en besiktningsman som uttalar sig om bristerna.


2. Ta reda på dina rättigheter

Vad kan du kräva av hantverkaren?

I första hand: att hantverkaren åtgärdar felet

Du kan i första hand kräva att hantverkaren rättar till felet. Hantverkaren ska stå för alla kostnader som är förknippade med att åtgärda felet, som material, resor och arbete. Även om du hellre vill vända dig till ett annat företag har hantverkaren oftast rätt att försöka åtgärda felet. Att du är missnöjd eller tappat förtroendet är oftast inte tillräckligt. Men är det uppenbart att hantverkaren inte har rätt kompetens för att åtgärda felet kan du argumentera för att du ska få ett prisavdrag eller häva avtalet.

I andra hand: att du får ett prisavdrag

Prisavdraget ska motsvara felet, till exempel vad det kostar att få felet åtgärdat av ett annat företag. Är det ett skönhetsfel som inte påverkar funktionen? Då kan det bli aktuellt med ett prisavdrag som motsvarar värdeminskningen felet orsakar.

I tredje hand: att du får häva avtalet

Att häva avtalet innebär att arbetet avbryts. Hävs hela avtalet har företaget inte rätt till betalning. Men du kan behöva lämna tillbaka material, om det inte medför några stora besvär eller kostnader för dig. Har du nytta av delar av arbetet som gjorts hävs inte hela avtalet. Då får du betala hantverkaren för det arbete du har nytta av.

Om hantverkaren inte avrått dig

Hantverkaren är skyldig att avråda dig från att få arbete utfört som inte är till någon nytta för dig. Till exempel om företaget lagt nya takpannor trots att de sett att hela taket behöver åtgärdas. Har hantverkaren inte avrått dig? Då ska du generellt inte behöva betala mer än för arbetet de gjort för att kunna konstatera att de bör avråda dig.


Så lång tid får det ta att åtgärda felet

Hantverkaren ska åtgärda felet inom skälig tid. Vad som är skälig tid bedöms från fall till fall. Det beror bland annat på typ av fel och på ditt behov av att få det åtgärdat. I vissa fall måste felet åtgärdas snabbt för att undvika att felet förvärras eller orsakar andra skador. Eller så påverkar felet din vardag mycket, till exempel om du inte kan använda badrummet. I andra fall kan det vara mindre akut att åtgärda felet. Säsongen kan också göra att det inte går att åtgärda felet på en gång. Det kan till exempel vara olämpligt att måla om fasaden på vintern.


Ersättning på grund av felet

Att tjänsten är felaktig ska inte medföra några extra kostnader för dig. Företaget ska stå för kostnaden att åtgärda felet. De ska dessutom ersätta eventuella merkostnader. Exempel på merkostnader kan vara:

  • inkomstförlust, till exempel om du måste ta ledigt från jobbet för att titta på felet tillsammans med företaget

  • kostnad för utlåtande från besiktningsman eller annan sakkunnig (om det behövs för att kunna bevisa felet).

Du måste kunna bevisa dina kostnader

För att få ersättning behöver du kunna visa underlag på vilka kostnader du haft, till exempel kvitton, fakturor eller andra intyg. Kostnaderna ska vara rimliga och ha direkt koppling till felet. Vill du ha ersättning för inkomstförlust behöver du kunna styrka den, till exempel med ett intyg från arbetsgivaren. Du kan inte kräva ersättning för besväret eller tiden du lägger ner på att klaga på felet.


Om hantverkaren orsakat skador – då kan du få skadestånd

Har hantverkaren orsakat skador när de utfört arbetet? Då har du rätt att kräva skadestånd enligt konsumenttjänstlagen. Det kan handla om att:

  • föremålet för arbetet skadas

  • hantverkaren skadar någon annan egendom, till exempel tappar ett verktyg och skadar golvet.

Skadeståndet är menat att ersätta skadan. Du kan inte räkna med att få ersättning för något som gör att du hamnar i en bättre sits än innan skadan. Har du till exempel fått en repa i golvet är det inte rimligt att du får hela golvet utbytt utan kostnad. Ibland har företaget som orsakat skadan kompetens att åtgärda den. Då kan du behöva acceptera att företaget åtgärdar skadan istället för att ge dig ekonomisk ersättning.


Så lång tid har du på dig att klaga på fel

Tycker du att det finns fel ska du reklamera (klaga). Det gör du genom att meddela företaget. Du måste klaga på felet inom skälig tid från att du upptäckte det. Inom två månader räknas alltid som skälig tid. Du kan reklamera fel som gäller arbete på fast egendom, mark och byggnader i 10 år. Övrigt arbete kan du reklamera i 3 år.

Arbete på fast egendom, mark och byggnader

Vid arbete på fast egendom har du rätt att klaga på eventuella fel i 10 år efter att arbetet blev klart. Det omfattar bland annat:

  • renovering av byggnad

  • målning

  • golvläggning

  • dränering

  • takbyte

  • borrning av vattenbrunn

  • nedgrävning av fiber.

Övrigt arbete

För arbete som utförs på lösa saker kan du som regel reklamera i 3 år. Till exempel är det 3 års reklamationsrätt på de flesta reparationstjänster.


3. Kontakta hantverkaren för att klaga på felet

Kontakta företaget så snart som möjligt när du upptäcker fel och ställ dina krav. Företaget behöver ofta komma och titta på felet för att kunna avgöra vad som orsakat felet och vad som behöver göras. Om företagets undersökning visar att felet inte är orsakat av deras arbete kan du behöva betala för arbetet kopplat till felsökningen. Har företaget gjort fel ska de åtgärda felet utan kostnad för dig. Hantverkaren ska stå för alla kostnader som är förknippade med att åtgärda felet, som material, resor och arbete.

Kontakta företaget skriftligen

Det är bra att ha skriftligt underlag som visar att du har kontaktat företaget för att klaga. Du kan skicka sms eller mejl. Då kan du också bifoga underlag som visar felet, till exempel bilder. Om du ringer kan det vara bra att du efter samtalet sammanfattar vad ni diskuterade, och skickar i ett mejl till företaget.

Krav på ersättning

Har du krav på ersättning för extra kostnader eller skador riktar du även det kravet till företaget. Skriv vilka kostnader du vill att företaget ska ersätta och varför.


4. Din rätt att hålla inne betalning vid fel

Finns det fel i arbetet har du enligt lag rätt att hålla inne med en del av eller hela betalningen. Det fungerar som ett påtryckningsmedel mot företaget och en säkerhet för dig.

Så stor del av betalningen kan du hålla inne med

Betalningen du håller inne med ska motsvara felet. I princip betyder det att du kan hålla inne med så stor summa att det täcker kostnaden för att ta in ett annat företag för att åtgärda felet. Om du inte vet exakt vad det kostar att åtgärda felet kan du hålla inne en summa med viss marginal. Ibland kan det hjälpa att kontakta andra företag inom branschen för att få en prisuppgift på vad det skulle kosta att åtgärda felet.

Meddela företaget att du håller inne med betalning

Det är viktigt att du skriftligen meddelar företaget att du håller inne med betalning och varför. Du kan till exempel skicka ett mejl eller ett sms. Har du fått en faktura behöver du bestrida (protestera mot) den. Det innebär att du förklarar att du inte kommer att betala fakturan och varför. Var tydlig med att det handlar om att det finns fel i arbetet och att du håller inne med hela eller delar av betalningen.

Skadeståndskrav för skador företaget orsakat

Om företaget orsakat skador på något annat i ditt hem kan du inte hålla inne motsvarande summa på fakturan för tjänsten som företaget utfört. Om företaget har slutfört tjänsten utan fel är du skyldig att betala fakturan även om du har skadeståndskrav för andra skador de orsakat. De ersättningskrav du har för skadorna kan du ställa som separata krav till företaget.


5. Så gör du om hantverkaren inte åtgärdar felet

Hantverkaren håller inte med om felet

Tycker hantverkaren att arbetet är felfritt? Eller att felet inte beror på deras arbete? För att du ska kunna kräva något av företaget behöver du kunna bevisa att det finns fel eller att felet beror på deras arbete. Kan du inte visa felet genom bilder eller liknande kan du ta hjälp av en sakkunnig, till exempel en besiktningsman. Den sakkunnige får bedöma och ge ett utlåtande om arbetet. Se till att få skriftligt underlag från den sakkunnige och spara som bevis.

Kontakta hantverkaren igen

Har du ytterligare bevis på att hantverkaren gjort fel kontaktar du hantverkaren igen. Tänk på att ta kontakt skriftligen, till exempel via mejl eller sms. Skicka med en kopia på bevisen. Säger hantverkaren fortfarande nej eller inte svarar, kan du få ditt ärende prövat, till exempel av Allmänna reklamationsnämnden.

Företaget åtgärdar inte felet

Om hantverkaren inte åtgärdar felet inom skälig tid kan du vända dig till ett annat företag som får åtgärda felet.

Vad är skälig tid?

Enligt lag ska hantverkaren åtgärda felet inom skälig tid. Vad som är skälig tid bedöms från fall till fall. Det beror bland annat typ av fel och ditt behov av att få det åtgärdat. Det är viktigt att du kan visa att du har klagat på att det tar för lång tid innan du vänder dig till ett annat företag. Har du hållit inne med betalning på grund av felet kan du samtidigt meddela att du tänker använda den summan för att bekosta arbetet. Har du redan betalat för arbetet kan du meddela att du kommer kräva ersättning för kostnaden för att ta in ett annat företag.

7. Om du vill få ärendet prövat

Tvistlösning via Allmänna reklamationsnämnden

Om du och företaget inte kommer överens kan du göra en anmälan till myndigheten Allmänna reklamationsnämnden (ARN). ARN bedömer ditt ärende och lämnar en rekommendation om hur tvisten ska lösas. De flesta företag följer ARN:s rekommendationer. Det kostar inget att få ditt ärende prövat av ARN. En normal handläggningstid är cirka 6 månader. Har företaget sagt nej till dina krav kan du anmäla direkt. Om du inte fått svar från företaget behöver det ha gått 30 dagar innan du kan anmäla till ARN. Om du anmäler tidigare kommer din anmälan att avslås.

Krav för att ARN ska kunna pröva ditt ärende

  • Företaget har sagt helt eller delvis nej, eller inte svarat dig.

  • Summan som du och företaget är oense om måste vara 2000 kronor eller mer.

  • Du måste anmäla inom ett år från det att du klagade till företaget första gången.

Ibland kan kommunens konsumentvägledare hjälpa dig att göra en anmälan till ARN. Om ARN inte kan pröva ditt ärende eller om företaget inte följer ARN:s rekommendation har du möjlighet att få tvisten avgjord av domstol.

Om du gått igenom stegen i den här processen men fortfarande har en tvist med företaget, kan du ta tvisten till domstol. Då vänder du dig till tingsrätten. Till skillnad från att anmäla till ARN kostar det pengar att lämna in en ansökan till domstol. Är du osäker på om du ska vända dig till domstol eller behöver hjälp med att driva ditt fall, kan du ta hjälp av en jurist. När du funderar på att anlita juridisk hjälp kan du först kontakta ditt försäkringsbolag. I många hemförsäkringar finns ett så kallat rättsskydd. Det betyder att försäkringen kan täcka vissa kostnader i samband med juridiska processer.

Vad kostar det?

För en tvist som rör ett krav under 28 650 kronor (ett halvt prisbasbelopp år 2024), ett så kallat förenklat tvistemål eller småmål, är ansökningsavgiften 900 kronor. Om kravet är över 28 650 kronor, eller om tvisten inte rör något bestämt belopp, är ansökningsavgiften 2 800 kronor. Om du förlorar tvisten kan du bli tvungen att betala både dina och företagets rättegångskostnader. Men i småmål är kostnaderna du kan tvingas betala begränsade.
